1. Services Provided

Delivqr provides business owners with tools to:

  • Create profiles, list menu items, and showcase services to customers in targeted geographic areas.
  • Generate QR codes for direct landing page access.
  • Manage business hours, time zones, and operational features such as enabling or disabling order acceptance.
  • Facilitate order placement via WhatsApp using pre-defined message templates.

2. Payment and Subscription

  • Business owners subscribe to display their profiles in specific polygon areas using secure payment processors such as Stripe.
  • Payments are processed securely, and subscription terms are outlined at checkout.
  • Fees paid for subscriptions are non-refundable under any circumstances.

3. Business Owner Responsibilities

  • Provide accurate and complete business information, including legal documentation where required.
  • Confirm orders through direct communication with customers (via call, WhatsApp, or message).
  • Manage their profile and ensure accurate visibility of business hours, contact details, and menu listings.
  • Include clear information about potential allergens in food items and adhere to local laws and safety regulations.
  • Ensure timely payment collection directly from customers, as Delivqr does not process payments between customers and businesses.

4. End-User Responsibilities

  • Customers are advised to place orders with businesses they trust and are familiar with.
  • Verify allergen information, delivery details, and pricing before completing a transaction.
  • Payments for goods and services are made directly to the business without Delivqr's involvement.
  • Share location data with businesses only for delivery purposes and check the received items before payment.

5. Orders and Delivery

Order Placement: Orders are sent from customers to businesses via WhatsApp using pre-defined messages. Customers and businesses are mutually responsible for confirming and managing order details.

Delivery Responsibility: The delivery of items is solely the responsibility of the business. Delivqr does not offer delivery services and is not liable for delivery delays or issues.

Pick-Up Services: For pick-up orders, businesses must confirm the order details with the customer before the pick-up time.

6. User Content and Material

Users are prohibited from uploading, posting, or transmitting content that:

  • Violates any local, national, or international laws.
  • Contains unauthorized advertising, malware, or harmful programs.
  • Is offensive, defamatory, or infringes on intellectual property rights.

Delivqr reserves the right to monitor, edit, or remove content that violates these terms or applicable laws.

7. Acceptable Use Policy

Users may not:

  • Misuse the platform or engage in fraudulent activities.
  • Use automated tools to scrape or collect data from the platform.
  • Impersonate others or use the platform for harassment, discrimination, or illegal activities.

Delivqr may suspend or terminate user accounts in case of policy violations.

8. Refund Policy

  • Businesses may avail of a three-month free trial to test the services.
  • Paid subscriptions are non-refundable under any circumstances.

9. Listings and Prohibited Items

Businesses must:

  • Be legally permitted to sell the items or services listed on their profiles.
  • Provide accurate descriptions and ensure listings comply with applicable laws and regulations.
  • Avoid listing counterfeit or prohibited items as outlined by local laws.

10. Breach of Terms

In case of violations, Delivqr reserves the right to:

  • Suspend or terminate user accounts.
  • Take legal action where necessary.

11. Reporting Infringements

12. Intellectual Property Rights

All content on Delivqr's platform, excluding user-generated content, is owned or licensed by Delivqr. Users may not reproduce or use any content for commercial purposes without prior permission.

13. Modifications to the Platform

Delivqr reserves the right to update platform features and content without prior notice to reflect changes in business needs, laws, or technological advancements.

14. Termination of Agreement

Delivqr may terminate or suspend services for violations of these terms or if deemed necessary for operational reasons.

15. Governing Law

These terms are governed by the laws of the United Arab Emirates, and disputes will be resolved under UAE jurisdiction.
